SSD Widows/Survivor Claims

If you are disabled and your husband or wife died in the last 10 years, you may be able to obtain SSD benefits based on your spouse’s work history. SSD benefits are based on how much you have paid into the system. If your spouse was the primary wage earner in the family, you stand to obtain more benefits by filing a widow/survivor claim than by filing a claim based on your own work history.

In order to qualify for widow/survivor SSD benefits:

  • You must have a qualifying physical impairment or mental health impairment
  • Your disability must have lasted at least 12 months or be expected to last for another 12 months, or be expected to result in death
  • You must have been married for at least 10 years
  • Your spouse must have died within the last 10 years

Social Security Disability Over Age 50

Age is one factor the SSA takes into account when determining eligibility for SSD benefits. It is generally more difficult for older workers to obtain new employment and the SSA recognizes this fact. If you are over age 50 and seeking SSD benefits, you have a better chance of obtaining them than a younger person, all other factors being the same.
